The Calcutta High Court ruled that courts cannot rewrite a contract between parties, setting aside an award granted by an Arbitral Tribunal in favor of South Eastern Railway, which was demanding service tax reimbursement from a private company. The ruling observed that violating this concept is in conflict with the fundamental policy of Indian law and justice. The company had approached the HC to challenge the award, which demanded reimbursement of service tax amounting to Rs 49,53,763 along with interest.
